3. Consent and Legal Compliance

3.1 Your Representations and Warranties

By using our Services, you represent and warrant that:

• You have obtained explicit, informed consent from all individuals whose data you process through our platform;
• You are legally authorized to request data erasure, monitoring, or reporting for the subjects in question;
• You will use our Services only for lawful purposes and in compliance with all applicable laws, including but not limited to data protection regulations (GDPR, CCPA, etc.);
• You will not use our Services to stalk, harass, intimidate, or harm any individual;
• All information you provide to Erasely AI is accurate, current, and complete.

3.2 Prohibited Uses

You may NOT use our Services to:

• Monitor, gather information about, or request data erasure for any individual without their explicit consent;
• Engage in surveillance or intelligence gathering for unlawful purposes;
• Violate any person's privacy rights or other legal rights;
• Circumvent or attempt to circumvent any technological measures we implement;

3.3 Verification Rights

Erasely AI reserves the right to request proof of consent or legal authorization at any time. Failure to provide adequate documentation may result in immediate suspension or termination of your account and Services.

4. Account Registration and Security

Refund Policy: Due to the nature of our Services (data erasure requests are submitted immediately, reports are generated on-demand, and monitoring begins upon activation), all sales are final. Refunds are provided only in cases of documented service failure or at our sole discretion.

Subscription Renewals: Subscription-based services automatically renew at the end of each billing cycle unless cancelled prior to renewal. You may cancel your subscription at any time through your account dashboard.

6. Intellectual Property Rights

The Services, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, are owned by Erasely AI and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purposes. You may not:

• Copy, modify, distribute, sell, or lease any part of our Services;
• Reverse engineer or attempt to extract source code from our platform;
• Remove or alter any proprietary notices or labels;

Data erasure effectiveness depends on third-party compliance with legal obligations and our requests. Some entities may refuse or delay compliance, which is beyond our control.

8.3 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERASELY AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, or business opportunities;
• Service interruptions or data loss;
• Third-party actions or failures to comply with requests;

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO ERASELY AI IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Erasely AI and its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Services;
• Your violation of these Terms;
• Your violation of any rights of third parties, including privacy rights;
• Your failure to obtain necessary consent for data processing;

11. Term and Termination

Erasely AI may suspend or terminate your access immediately, without notice, if:
